Its my understanding in the state of INDIANA forclosures and estate properties are exempt from having to disclose any known problems with a property. In these cases, if something arises that wasnt disclosed, knowingly or unknowningly, who is liable? The executor of a will???

No one is liable. The property is sold as is with no representations. how could an executor who never lived in the house have any knowledge?

As long as a potential buyer has the opportunity to have an inspector come in and examine the property then I really see no problem with this. However a law that forces complete transparency and requiring an inspection and evaluation before putting the property up for sale provides for a safety net for everyone involved in my opinion.
